Terms of Service

1. Acceptance of Terms

By accessing or using GenApp at genapp.co.za (and its subdomains), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the service. These Terms form a binding agreement between you and Corrie Muller ("GenApp", "we", "us"). For questions, contact us at corrie.muller01@gmail.com.

2. Description of Service

GenApp is an AI-powered platform that allows users to describe software application ideas and receive generated, production-ready code and configurations. The service includes:

  • AI-assisted app generation powered by Anthropic's Claude models.
  • Storage and management of generated app files and ZIP archives.
  • Google service integrations (Gmail, Drive, Calendar) via OAuth on subdomains such as gmail.genapp.co.za.
  • Organisation management and collaboration features.

3. Eligibility

You must be at least 13 years of age to use GenApp. By creating an account, you represent that you meet this requirement and that all information you provide is accurate. If you are using GenApp on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at corrie.muller01@gmail.com if you suspect unauthorised access. We are not liable for any loss arising from your failure to safeguard your credentials.

You may not create accounts using automated means, share your account with multiple people, or impersonate another person or entity.

5. Acceptable Use

You agree not to use GenApp to:

  • Generate malware, spyware, ransomware, or any malicious code.
  • Build applications that facilitate illegal activity, harassment, or fraud.
  • Attempt to reverse-engineer, scrape, or overload our platform.
  • Violate the terms of any third-party service (including Google's APIs or Anthropic's usage policies).
  • Generate or distribute content that infringes intellectual property rights.
  • Collect personal data from others without appropriate legal basis.
  • Circumvent authentication, rate limits, or other security controls.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Intellectual Property

6.1 Generated Code

The code and files generated by GenApp based on your prompts are owned by you. You are free to use, modify, deploy, and commercialise them without restriction or royalty.

6.2 GenApp Platform

The GenApp platform, including its UI, templates, and underlying infrastructure, is owned by us and protected by copyright and other intellectual property laws. You may not copy, redistribute, or create derivative works of the platform itself.

6.3 Your Prompts

You retain ownership of the prompts you submit. By submitting a prompt, you grant us a limited, non-exclusive licence to process it for the purpose of generating your requested output. We do not use your prompts to train AI models.

7. Google API Services

Features on gmail.genapp.co.za and other Google-integrated subdomains use Google APIs. By connecting your Google account, you authorise GenApp to act on your behalf for the specific scopes you grant. You may revoke this access at any time via your Google Account Permissions.

Our use of Google API data is governed by the Google API Services User Data Policy. We will only use Google user data for the purposes explicitly described to you and as permitted under that policy.

8. Payments & Subscriptions

Certain features of GenApp may require a paid subscription. Payments are processed securely by Yoco. All prices are displayed at the time of purchase. Subscriptions renew automatically unless cancelled before the renewal date.

Refunds are handled on a case-by-case basis. If you believe you were charged in error, contact us within 14 days of the charge at corrie.muller01@gmail.com.

9. AI Disclaimer

GenApp uses AI to generate code and application structures. Generated output may contain errors, security vulnerabilities, or incomplete implementations. You are solely responsible for reviewing, testing, and validating any generated code before using it in production. We make no warranty that generated code is fit for any particular purpose.

10. Disclaimers of Warranty

GenApp is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, GenApp and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

You may close your account at any time from your account settings or by contacting us. We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms, with or without prior notice.

Upon termination, your right to use the service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, liability limitations, and dispute resolution) will continue to apply.

13. Changes to Terms

We may modify these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
